Yes. An alcohol test, normally done through breath on a minor, is evidence. They do not necessarily need breath test because there can be other evidence. An officer can testify to personal observations which is also evidence. For example, often the police report will state that the suspect had alcohol on their breath, blood shot watery eyes, slurred speech, etc. Not having a chemical test done does give an argument.
